1. Acceptance of Terms

By accessing or using the ProtoHive3D website, products, or services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

2. Use of Services

You agree to use our services only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that:

• Any files you upload do not infringe on the intellectual property rights of others.
• You have the legal right to reproduce any designs you submit for printing.
• Your use of our services complies with all applicable laws and regulations.
• You do not use our services to create illegal, harmful, or offensive objects.

3. Orders and Payments

3.1 Order Acceptance

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to:

• Product unavailability
• Pricing errors
• Suspected fraud or unauthorized use
• Violation of these Terms

3.2 Pricing and Availability

Pricing and availability may change without notice. We strive to maintain accurate pricing, but errors may occur. If we discover a pricing error, we reserve the right to cancel the order and refund any payment made.

3.3 Payment

Payment must be made in full before production begins. We accept payment through Stripe, which processes credit and debit cards securely. All prices are in USD unless otherwise stated.

3.4 Refunds and Cancellations

Orders may be cancelled before production begins for a full refund. Once production has started, cancellations are subject to our discretion and may incur fees. Completed orders are generally not eligible for refunds unless there is a defect in the product or an error on our part.

4. Quote Process and 3D Printing Services

4.1 Quote Process Disclaimer

When you submit a 3D model file for a quote, you acknowledge and agree that:

• The quote is an estimate based on the information provided and may be subject to change.
• You are responsible for ensuring your 3D model file is properly formatted, watertight, and suitable for 3D printing.
• We reserve the right to refuse to print files that are unsafe, illegal, or violate these Terms.
• Quotes are valid for 30 days from the date of issue.

4.2 3D Printing Quality Disclaimer

Important: The quality of 3D printed products is inherently limited by several factors beyond our control:

• File Quality: The quality of your 3D model file directly impacts the final print. Files with errors, non-manifold geometry, or improper scaling may result in imperfect prints.
• Material Properties: Different materials (PLA, PETG, etc.) have different characteristics, limitations, and tolerances that affect the final product.
• Equipment Limitations: Our 3D printers have inherent limitations including layer height, resolution, and build volume constraints that affect print quality.
• Design Complexity: Complex geometries, overhangs, and fine details may not print perfectly due to the nature of additive manufacturing.

We commit to doing our best to produce high-quality prints, but we cannot guarantee that every print will be perfect. Minor imperfections such as layer lines, slight warping, support marks, or surface variations are normal and expected in 3D printing and do not constitute defects.

If you require more control over the printing process, higher precision, or specific quality requirements, we recommend requesting a Design Consultation before placing your order. Our consultation service allows us to review your file, discuss your requirements, and provide guidance to achieve the best possible results.

4.3 File Requirements

You must provide 3D model files in .stl or .3mf format. Files must:

• Be under 10MB in size
• Fit within our printer's build volume (235×225×255 mm)
• Be watertight and manifold (no holes or non-manifold edges)
• Be properly scaled (in millimeters)

5. Filament and Product Sales

5.1 Product Descriptions

We strive to provide accurate product descriptions, images, and specifications. However, we do not warrant that product descriptions or other content on the site are accurate, complete, reliable, current, or error-free.

5.2 Inventory and Availability

We reserve the right to limit quantities, discontinue products, or refuse orders. If a product becomes unavailable after you place an order, we will notify you and provide a full refund.

5.3 Shipping

Shipping costs are calculated at checkout. Free shipping is available for orders over $100. We are not responsible for delays caused by shipping carriers or customs. Delivery times are estimates and not guaranteed.

6. Intellectual Property

6.1 Our Intellectual Property

All content, trademarks, logos, designs, and other intellectual property on this site are the property of ProtoHive3D or its licensors and may not be used without our written permission.

6.2 Your Intellectual Property

You retain all rights to your 3D model files and designs. By submitting files for printing, you grant us a limited license to use, reproduce, and modify the files solely for the purpose of fulfilling your order. We will not use your designs for any other purpose without your permission.

7. Limitation of Liability

To the fullest extent permitted by law:

• ProtoHive3D shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
• Our total liability for any claim shall not exceed the amount you paid for the specific product or service giving rise to the claim.
• We are not responsible for any loss or damage resulting from:
  • Your failure to provide accurate information
  • File format errors or incompatibilities
  • Design flaws in your 3D model
  • Material limitations or properties
  • Shipping delays or carrier issues
  • Use of products for purposes other than intended

8. Indemnification

You agree to indemnify and hold harmless ProtoHive3D, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit, including 3D model files

9. Dispute Resolution

If you have a dispute with us, we encourage you to contact us first through our Contact Us form to resolve the issue. If we cannot resolve the dispute informally, you agree that any legal action will be brought in the courts of the jurisdiction where ProtoHive3D is located.

10. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of any material changes by posting the updated Terms on this page with a new effective date. Your continued use of our services after such changes constitutes acceptance of the updated Terms.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ProtoHive3D regarding your use of our services and supersede all prior agreements and understandings.
